The judicial debt collection procedure is a way to formally pursue outstanding monetary claims. It is used to enforce payment for unpaid invoices, services, or other financial obligations.
Especially in cases involving clear and verifiable claims, the debt collection procedure can offer a quick and relatively cost-effective solution.
Advantages of the Debt Collection Procedure
In many cases, debtors respond at the latest after a court order for payment is served.
When is a dunning procedure advisable?
A court dunning procedure is an option if:
If the debtor does not file an objection to the order for payment, an enforcement order can be requested. This forms the basis for further measures such as bank account garnishments or the engagement of a bailiff.
Debtor’s Objection
The debtor has the option to file an objection to the order for payment. In this case, the proceedings transition to standard court proceedings, provided this has been requested. If this was not done in the order for payment, it can still be requested at this stage.
